Please read these Terms and Conditions (“Terms and Conditions”, “Terms”) carefully before using the https://castle-retreat.com website (“Service”) operated by Acacia Coaching and Development Ltd. (“us”, “we”, or “our”).

By accessing or using the Service you agree to be bound by these Terms and Conditions.

Privacy Policy

We respect and are committed to your privacy at Castle Retreat. We do not distribute or sell your personal information to any third parties. This includes, not only your email address, but any personal information you input during your use of the site.

We reserve the right to change this policy in the future, but not without giving notice and providing individuals with the opportunity to opt-out.

Payments

Payments can be made online through our automated system, with debit or credit card or PayPal.

We cannot accept credit/debit card details by email as this is not a secure payment method.

Your payment includes a 10% non-refundable deposit.

How to Pay

Click the book now link, follow the on screen instructions and enter your payment details on our secure server. You will be sent an email confirming that your order has been placed. Please ensure that you enter your details accurately, especially your email address and telephone number as we may need to contact you regarding your purchase.

Secure Online Payments

Our servers use SSL (Secure Sockets Layer) encryption. This is an industry-standard protocol to transfer information via the Internet securely. When SSL encryption is being used you will see the padlock symbol in your browser and the URL will begin HTTPS as opposed to HTTP.

Cancellation Policy

If you wish to cancel your retreat booking, please inform us as soon as possible. You can contact us at [email protected]. As stated above, your deposit is non-refundable. The following policy applies.

*Where possible, we will endeavor to transfer your booking to an alternative date.

You will receive a full refund if you cancel within 48 hours of booking, if the cancellation occurs at least 14 days before check-in.

In the event you are unable to attend the Retreat you may transfer your Retreat place to another named person. There is no refund for leaving the Retreat early or arriving after the scheduled start time. There is no partial reimbursement if you choose to opt out of any part of the programme.

We aim to process all cancellation requests within 10 working days of receipt.

Once your cancellation has been processed, an email will be sent to confirm the completion of your refund or exchange. Refunds will only be made against the original credit/debit card/bank details.

If you haven’t received a refund, we ask that you please recheck your bank account or credit card, as it may take some time before your refund is officially posted.

Additional Information

While we have never cancelled a retreat, if we must cancel a specific date for any reason, you may transfer your full retreat payment to another date, or you may request a refund of your payment to us, constituting a full settlement.

Acacia Coaching and Development Ltd. (trading as Castle Retreat) is not responsible for your expenses incurred in preparation for any cancelled retreat, such as train tickets, loss of work, and/or other costs associated with preparing for your trip.

If for any reason the retreat coach/facilitator becomes unavailable we will do our best to find a replacement with the same standard of qualifications. Wherever possible you will be advised in advance of any alterations. Our venue may be altered or amended due to maintenance work, mechanical faults, weather conditions, sickness or other situations outside our control. In this unlikely situation we would endeavor to find an alternative facility of a similar standard.

We use third parties in connection with the Retreat. For example the accommodation, meals and some guest talks and activities may be provided by carefully chosen third parties. We ordinarily contract with these third parties on their normal terms of business which may not be entirely consistent with this agreement. If any delay or failure by a third party properly to provide subcontracted services causes a delay or failure in the performance of this agreement:

  • we shall use all reasonable endeavors to apply for your benefit all rights or remedies available from the relevant third party; and
  • except to the extent the delay or failure is caused by a failure to use our best care and skill in the management or selection of a third party, we shall not be in breach of this agreement and shall have no liability to you arising out of any such delay or failure.

Liability

Unexpected things do happen, so we strongly advise that you purchase travel cancellation insurance once you have made your reservation.

We do NOT accept any liability for cancellations, delays or changes caused by war, threat of war, terrorist actions or threats, civil strife, industrial action, natural disaster, declared emergencies or epidemics, technical problems to transport, staff cancellations or other events beyond our control, participants’ health conditions which may develop during or subsequent to the retreat, loss of, or damage to, personal property of participants.

Attendance at the Retreat is not therapy or counselling. You acknowledge that deciding how to handle any issues which may arise, the choices you make in relation to them and following through on any agreed action is exclusively your responsibility. For this reason, although we fully expect great things to happen at the Retreat, we cannot guarantee any specific outcomes or that all attendees will achieve the same results.

If you are currently receiving treatment from a doctor or other healthcare professional, by entering into this agreement you confirm that you have consulted with this person regarding the advisability of attending the Retreat and that this person is aware of and supports your decision to attend.

Except for any legal responsibility that we cannot exclude in law (such as for death or personal injury), we are not legally responsible for:

  • any losses that:
    • were not foreseeable to you and us when the contract was formed; and
    • that were not caused by any breach of these terms on our part.
  • business losses, including loss of business, loss of profits, loss of management time and loss of business opportunity.

Our total liability to you is limited to the amount of fees paid by you for the Retreat.

Before you book your retreat, we ask that you read and understand these Terms and Conditions. By completing the booking process, you will be indicating that you understand the terms and conditions of the booking.

There is no contract between Acacia Coaching and Development Ltd. (trading as Castle Retreat) and the client until full payment has been made.

Intellectual property

If we provide you with any materials, whether digital or printed, any intellectual property in those materials belongs to us and unless we agree otherwise you can only use those materials for your own personal use and you may not share them with third parties.

Photograph release

We may photograph and video group activities for use in future marketing materials and by entering into this contract with us you hereby give to us your consent to use your image for this purpose.

Resolving problems

We hope you enjoy the Retreat, in the unlikely event that there is a problem with the Retreat, please contact us as soon as possible and give us a reasonable opportunity to sort out any problems with you and reach a positive outcome.

We shall try to resolve any disputes with you quickly and efficiently.
If we cannot resolve a dispute using our internal complaint handling procedure and either of us want to take court proceedings, the relevant courts of England and Wales will have exclusive jurisdiction in relation to this contract.

Acacia Coaching and Development Ltd. has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Acacia Coaching and Development Ltd. shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms and which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions at any time. If a revision is material we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
